Current Law

SUNucate legislation has been enacted. 2013: S 595 and S 595A enacted. Students may possess and use sunscreen at public and private schools. Written parental/guardian permission required. Assistance allowed for students unable to apply. Multiple failed attempts (S 7824, A 10800, A 2126, A 2126A).

Comparison to the SUNucate Model Bill

New York has adopted core SUNucate concepts, including student possession/use; staff assistance. The state does not yet fully mirror the model bill where additional provisions remain available, such as youth camp protections, sun-protective clothing, hats and sunglasses, sun-safe education, or a sunscreen sales-tax exemption.

Opportunities for Improvement

Adopt the full SUNucate model, including youth camp protections; sun-protective clothing; hats and sunglasses; sun-safe education; and a sunscreen sales-tax exemption.

Medical Spa Safety Act

Current Law

New York does not have any state laws regulating medical spas. The New York Department of State has published resources for medical spas, stating that only physicians or some nurse practitioners may own a medical spa. Any business offering cosmetic medical procedures must be licensed as a medical facility or medical practice. Only physicians and physician assistants may perform dermal fillers, neurotoxin injections, any laser procedures other than laser hair removal, or chemical peels.

Opportunities for Improvement

Since there are no laws in place, New York would benefit from enacting the Medical Spa Safety Act, which would explicitly regulate medical spas, prevent conflicting Board opinions, and reduce confusion for patients and practitioners.
