Current Status: Enacted

Current Law

SUNucate legislation has been enacted. 2018: HB 1228 enacted. Students may possess and use sunscreen at school entities during school hours, activities, or under supervision. Parental/guardian must sign a form; Department of Education provides a model form. Sun-protective clothing and hats allowed, subject to school prohibitions. 2023-2024: Additional legislation and regulatory guidance expanded sun protection.

Comparison to SUNucate

Pennsylvania has adopted core SUNucate concepts, including student possession/use; sun-protective clothing; hats/sunglasses. 

Opportunities for Improvement

Adopt youth camp protections; sun-safe education; and a sunscreen sales-tax exemption.

Medical Spa Safety Act

Current Law

Pennsylvania does not have any state laws regulating medical spas. Pennsylvania's business licensing guides state that a business that performs cosmetic medical procedures is considered a medical practice and must be owned by a physician. Cosmetic medical procedures can be performed by a physician, Pa, APRN, or RN.

Opportunities for Improvement

Since there are no laws in place, Pennsylvania would benefit from enacting the Medical Spa Safety Act, which would explicitly regulate medical spas, prevent conflicting Board opinions, and reduce confusion for patients and practitioners.
