Current Law

SUNucate legislation has been enacted. 2017: HB 412 enacted. Students may possess and use sunscreen at school, on buses, or at school functions. Staff may assist with written parental/guardian consent if student is unable. No liability for adverse reactions.

Comparison to SUNucate

Louisiana has adopted core SUNucate concepts, including student possession/use; staff assistance. The state does not yet fully mirror the model bill where additional provisions remain available, such as youth camp protections, sun-protective clothing, hats and sunglasses, sun-safe education, or a sunscreen sales-tax exemption.

Opportunities for Improvement

Adopt the full SUNucate model, including student possession and self-application of sunscreen; staff assistance with parental permission; youth camp protections; sun-protective clothing; hats and sunglasses; sun-safe education; and a sunscreen sales-tax exemption.

Medical Spa Safety Act

Current Law

Louisiana does not have any state laws pertaining to medical spas. The Louisiana State Board of Nursing declared that RNs may perform non-ablative laser treatments, botulinum toxin injections, and superficial chemical peels if the task is delegated by a physician or NP but may not be delegated dermal fillers and ablative lasers. The physician or NP must examine the patient before the procedure. The physician or NP must be physically present on site when delegating to an RN.

Opportunities for Improvement

Since there are no laws in place, Louisiana would benefit from enacting the Medical Spa Safety Act, which would explicitly regulate medical spas, prevent conflicting Board opinions, and reduce confusion for patients and practitioners.
