Current Status: Enacted

Current Law

SUNucate legislation was enacted in 2017. The law permits students to possess and self-apply sunscreen while at school. 2017: HB 2134 enacted. Students may possess and use sunscreen at school and school events without a note/prescription. Staff/volunteers may assist with written parental consent. Law also covers camps. No minimum age; sun-safe clothing/hats not specifically addressed.

Comparison to the SUNucate

Arizona has adopted core SUNucate concepts, including student possession/use; youth camp protections; staff assistance. The state does not yet fully mirror the model bill where additional provisions remain available, such as youth camp protections, sun-protective clothing, hats and sunglasses, sun-safe education, or a sunscreen sales-tax exemption.

Medical Spa Safety Act

Current Law

Arizona does not have any state laws pertaining to medical spas. The State Board of Nursing released an advisory opinion stating medical spas owned by an unlicensed individual must have a medical director, which must be a licensed physician or nurse practitioner. Injection of neuromodulators and the use of lasers require a good faith examination by a physician or nurse practitioner.

Opportunities for Improvement

Since there are no laws in place, Arizona would benefit from enacting the Medical Spa Safety Act, which would explicitly regulate medical spas, prevent conflicting Board opinions, and reduce confusion for patients and practitioners.
